Horst Platz Beratungs- & Vertriebs GmbH (hereinafter referred to as the “Company”) is pleased about your visit to our website and your interest in our company and our products. We take the protection of personal data very seriously. Personal data is provided voluntarily. The Company processes this data in accordance with the provisions of the European General Data Protection Regulation, the German Telemedia Act and the German Data Protection Act.

2. Personal data
Personal data refers to individual details about personal or factual circumstances of a particular or identifiable natural person. This includes information such as IP address, your real name, your address, your telephone number and your date of birth. Information that is not directly related to your real identity – such as favourite websites or the number of users of a page – is not considered personal data.
3. Processing of personal data
When you visit the Company’s website, we temporarily process and store data of various kinds. These include the connection data of the requesting computer, the web pages you select on our site and the date and duration of your visit. Furthermore, we determine the identification data of the Internet browser that you used, and the type of operating system as well as the website from which you visit us. Personal information such as your name, address, telephone number and email address will only be collected if you voluntarily provide this information as part of a registration process or a request for contact or information.
4. Purposeful use and disclosure of personal data
The Company uses the personal data you provide only to the extent required for the purposes of technical administration of the website, services, customer administration, product-related surveys and marketing.
5. Legal basis for data processing
The legal basis for processing your personal data depends on the purpose underlying the data processing.
– Technical administration of the website
The legal basis for processing personal data for the purpose mentioned above is Article 6 Para. 1 (b) GDPR if there is a contractual relationship with you. If there is no contractual relationship between you and the Company, the legal basis for data processing is Art. 6 Para. 1 (f) GDPR. The transmission of personal data (such as your IP address) is required for establishing the connection as well as for displaying the contents of the website.
– Services
The legal basis for processing personal data for the purpose mentioned above is Article 6 Para. 1 (b) GDPR. We provide our services within the scope of the fulfilment of contractual obligations. Without processing your personal data, we can not fulfil or execute our contract with you.
– Google Analytics
The legal basis for processing personal data within the framework of using Google Analytics is Article 6 Para. 1 (f) GDPR. We need statistical information on how to use our online offering to make it more user-friendly, measure our reach and conduct market research.
6. Disclosure of data
Your personal data shall not be transferred to third parties unless this is necessary for the purpose of executing the contract or you have given us your express consent. For example, it may be necessary for us to share your address and order details with your wholesale partner when ordering products. If we make use of external service providers, these are carefully selected and obligated under Art. 28 GDPR to comply with all data protection regulations.
7. Use of cookies
Cookies are used on some of our web pages. Cookies are small text files that are stored on your computer when you visit our website. This allows us to customize our website for the user. The data that a cookie uses, such as an access password, is stored on your computer. If you do not wish to use cookies, please change the cookie management settings in your Internet browser.
To display the Cookie Notice, we use CookieConsent from Silktide Insites. When loading, this tool briefly checks the geographical origin of the user’s IP address, to assign whether the display of the legal notice is relevant. 8. Newsletter
If you would like to receive the newsletter offered on the website, we need an e-mail address from you, as well as information that allows us to verify that you are the owner of the specified email address and that you agree to receive the newsletter (double opt-in method). To personalise the newsletter, we store personal information, e.g. your first name, last name and company name. We use this data only for delivering the requested information and for documentation of your consent. You can withdraw the consent you granted for storing the data, your email address and its use for sending the newsletter at any time and with effect for the future, such as via the “unsubscribe” link in the newsletter. We use an external service provider to administer and send our newsletter. This provider was of course carefully selected and, in accordance with Article 28 of the GDPR, obligated to comply with all data protection regulations.
9. Statistical evaluation
We need statistical information on how to use our online offering to make it more user-friendly, measure our reach and conduct market research. To do this, we use the web analytics tools described in this section.
9.1 Google Analytics
Google Analytics is provided by Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA (“Google”). This analysis software is configured in compliance with data protection regulations. In particular, we use Google Analytics with the additional feature offered by Google for the anonymisation of IP addresses. The IP address is usually already shortened by Google within the EU and only in exceptional cases only in the US, and in any case saved only in abbreviated form. 10. Data security
Our employees and our service providers are bound to confidentiality and complying with the applicable data protection laws. The Company will take reasonable technical and organisational security measures to protect your personal information from loss, alteration, destruction and access by unauthorised persons or from unauthorised disclosure. Our security measures are constantly being improved to keep up with the latest technological developments.
11. Duration of data storage
We usually store your data as long as this is necessary for the provision of our online offer and the associated services, or for as long as we have a legitimate interest in their further storage (e.g. we can still have a legitimate interest in postal marketing even after the fulfilment of a contract). The data is deleted after expiry of the statutory or contractual retention periods (for example, tax and commercial retention periods). Data that is not subject to the retention obligation will be deleted when the described purpose no longer exists.

13. Rights to information, correction or deletion of data

Furthermore, you have the right to correct or delete this data, provided the legal requirements are met. Data that is exempted from this entitlement to cancellation includes, for example, stored data on business processes that are subject to the statutory retention obligation.

15. Right to objection
In addition, you have the right to object to our data processing at any time. We will then stop processing your data, unless we can – in accordance with legal requirements – prove compelling legitimate reasons for further processing that supersede your rights.
16. Right to data portability
Furthermore, upon request, we guarantee the transferability of the personal data transmitted by you by providing them in a common and machine-readable data format.
17. Revocation of consent
You have the right to revoke your consent to the processing of your personal data, which you have given us for one or more specific purposes, at any time with effect for the future. The lawfulness of the processing of your data until the revocation remains unaffected.
18. Duty to provide personal information
If there is a contract between you and Horst Platz Beratungs- & Vertriebs GmbH, you must provide the personal data necessary for the commencement, execution and termination of the contractual relationship and for fulfilment of the associated contractual obligations, or the personal data to the collection of which we are legally obliged.
